These terms apply to any purchase by you of honey or beeswaxes goods from us, including honey, organic honey and beeswax goods (“goods”).

Online orders will only be accepted by us in New Zealand and payment is to be made in New Zealand currency.

The goods are offered for sale only to those who can make legally binding contracts. It is your responsibility to understand and comply with all applicable laws (including minimum age requirements for legally binding contracts) in relation to the use of the site and the purchase of goods from the site.

By placing an order for Goods, you warrant that you are capable of making a legally binding contract and that the goods purchased will be used in a lawful manner.

Goods may be added to or removed from this site from time to time. Sometimes goods described on this site may not be available. We reserve the right to limit quantities able to be ordered by you, or delivered to you. If your online order is reduced in accordance with this clause, the price payable by you for that online order will be adjusted accordingly.

Goods may be ordered by following the instructions on the pages of this site. We use "Shopify" for taking orders.

All prices quoted include Goods and Services Tax. Prices are exclusive of other taxes, duties and charges imposed or levied in New Zealand or overseas in connection with the supply of the goods.

Orders shipped outside of New Zealand may be subject to customs duty and taxes. These are not allocated by us but are instead charged by local customs. We do not take responsibility for any duties or taxes imposed by customs. For more information please contact your local import customs authority. We are not responsible for any refusal by the customer to provide required details to customs or refusal to pay tax/duties on their shipment. In this instance a refund will not be issued.

Prices may increase or decrease from time to time so check them carefully before ordering.

You must pay by credit or debit card following the instructions on this site. Visa and Mastercard are accepted for all transactions. We use “Strip" payment service for taking payments.

Where payment is by credit card, you are liable for all orders placed using your credit card.

If your payment is declined by your financial institution, delivery of the relevant online order will not be made. We reserve the right to refuse to accept payment from you by credit card for any reason. If you default in payment for any order, you are liable for all costs associated with debt collection.

When you place an order with us, you are making an offer to buy goods. All accepted orders supersede all previous quotes/estimates. We will take payment from you when we accept your order.

You warrant that all information and data provided by you is accurate, complete, and up to date. You will promptly notify us if there is any change to this information or data.

We reserve the right to refuse any order placed via the site at our sole discretion. Where payment for a refused order has been charged to your credit or debit card, we will refund the value of that order to the credit or debit card that was used for payment.

We will send you an email to confirm that we have received and accepted your order, which indicates that your order has been accepted, subject to availability of stock.

We may communicate with you regarding your account and orders using your email address, phone number (including text message) and other forms of communications that may reasonably be available to us.

Please review your confirmation email when it comes through to check that everything is correct. If something does not look right, then please contact us on [email protected].

Delivery of the goods to you will take place in the manner chosen by us unless agreed otherwise with you. We are not liable for any delay in delivery of goods ordered or non-delivery of goods ordered, other than in accordance with the provisions of the Consumer Guarantees Act 1993.

Delivery charges will be calculated for each order and shown as a separate item before you chose to enter your payment details and send the order to be processed. Delivery will be by courier or by any delivery service as chosen by us. We may change delivery fees at any time.

If we are unable to deliver any item, your credit or debit card will be credited with full all amounts you paid for the item. This can take around 7 working days, depending on bank processing times.

Goods are at our risk until delivered to your agent or carrier or on delivery of the goods to the nominated address supplied by you when placing the order. Once delivered, title and risk in the goods passes from your nominated store to you.

Title in the goods does not pass to you until payment has been received in full by us or our agent. You acknowledge that these terms create a security interest as defined in the Personal Property Securities Act 1999 (NZ) in favour of us in any goods purchased from this site. We can at any time register a financing statement on the Personal Property Securities Register to protect our security interest in the Goods. While we retain title to the goods you must properly store the goods and ensure the goods are identifiable as our goods.

Any contract arising from this site is governed by the laws of New Zealand.

Details on this site relating to the goods, including any descriptions or claims made in relation to the goods, have been prepared in accordance with New Zealand law and may not satisfy the laws or regulations of any other jurisdiction. We do not warrant that the details, descriptions or claims on this site concerning the goods satisfy the laws of any other jurisdiction.

It is your responsibility to determine whether these details, descriptions and claims satisfy the laws of the jurisdiction where you reside (if that jurisdiction is outside New Zealand) and if the details, descriptions or claims do not satisfy the laws of your jurisdiction, you may not order any goods from the site.

Certain weights, measurements and similar descriptions on the site are approximate and provided for convenience purposes only. We will make all reasonable efforts to accurately display the attributes of the goods, including applicable colours; however, the actual colour you see will depend on your computer and we cannot guarantee your computer will accurately display such colours.

Incorrect or defective orders must be reported to us within [x] 5 days of their receipt together with the order number. Any goods returned must be clean and free from price markings. Goods that have been damaged or are not resaleable may not be credited in full.

We do not allow returns for non-faulty goods purchased through our online shop. However, if items you have purchased are damaged, faulty or spoiled at the time of delivery, we will comply with our obligations under the Consumer Guarantees Act 1993. Please contact us on [email protected]. if you receive an item that you consider to be damaged, faulty or spoiled. Proof of purchase will be required.

While we try to ensure that the price and description of goods is accurate, if there is an error with the listing of goods on our site, a technical error in the processing of your order, or unavailability of goods, we reserve the right to refuse or cancel the order even if it had been accepted. In such cases we will refund in full all amounts you paid in respect of such unavailable goods.

All representations, terms, warranties, guarantees, or conditions whether express or implied by statute, common law or custom of the trade or otherwise, including, but not limited to, implied warranties, guarantees or conditions or merchantability and/or fitness for a particular purpose, tolerance to any conditions or similarity to sample are excluded and expressly negated to the fullest extent permitted by law.

Subject to our obligations under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, it is your responsibility to satisfy yourself that goods you purchase through our online shopping service are fit for the purpose you intend and to use all requisite care and skill when handling, using and/or consuming those goods. You warrant that you will not use goods purchased through our online shopping service for any purpose for which they are not suitable. You acknowledge that you cannot rely on any representation or statement made by us either through our online shopping service or otherwise, other than the express wording of these terms. We do not assume any obligation or liability for any advice given to you and you accept goods purchased through our online shopping service is entirely at your own risk.

We are not liable for anything that would or might constitute a breach of these terms where this arises out of circumstances beyond our control, including but not limited to acts of God, natural disasters, sabotage, accident, riot, shortage of supplies, equipment or materials, strikes and lockouts, civil commotion, computer viruses or hacking, breakdown of equipment, power supply failure or telecommunications failure, or malicious damage (“force majeure”). We will refund the full purchase price of orders that have been processed but cannot be delivered due to force majeure.

This site may be inaccessible from time to time due to events outside of our control, or for maintenance requirements. We cannot guarantee any file, data or program available for download from this site (or any third party site that is linked) is free of viruses and you assume the risk of any damage to your device as a result of using this site.
